Six Figure Settlement for Former Foster Child

MHP Sellors LLP secured a substantial six‑figure settlement, without admission of liability, for an adult who suffered prolonged physical and emotional abuse while placed in a Galway foster home. The claim also centred on alleged failures by statutory child protection agencies to ensure the safety, suitability and ongoing monitoring of the placement.

Background

The client was placed in long‑term foster care as a young child. Over many years in the placement, it was alleged that they experienced:

  • Repeated physical assaults by members of the foster household
  • Emotional mistreatment, intimidation and differential treatment
  • Delays in receiving appropriate medical attention
  • Pressure to withhold information from social workers

During the same period, other children in the home were later confirmed to have been sexually abused by an older member of the foster household, leading to a criminal conviction.

Although the client was not a complainant in those criminal proceedings, their experience formed part of a broader pattern of safeguarding failures within the foster environment.


Psychological Impact

 Expert evidence confirmed long‑term psychological injuries, including:

  • Symptoms consistent with post‑traumatic stress
  • Depression and suicidal ideation

  • Records of discussions about removing the client from the placement

The court emphasised the need for proportionate disclosure while protecting the privacy of other former foster children.

Following the High Court discovery rulings and the strength of the evidence, the matter resolved by way of a significant six‑figure settlement, achieved without admission of liability.
